Advisory disabled parking bays

In residential areas the Council has adopted the practice of providing Advisory Disabled Parking Bays, free of charge, for those residents meeting the necessary criteria.

Guidance Notes
It is important to note that the bays are advisory and are not enforceable. No action can be taken by the Council or Northumbria Police should the bay be used by other drivers.

Timescale
The bay should take approximately 4 months to implement from the approval of the request, you will receive a letter informing you of your eligibility of a bay.

Criteria
Specific criteria have to be met before approval is given (see details below).

Although we will look favourably on an application for an ADPB, there will be times when there are road safety implications and approval for the bay cannot be given.

Consultation
Your immediate neighbours and local Ward Councillors will be informed of your application for an ADPB. Should any objection to the proposals be received the views of the Ward Councillors will be sought.

It should be noted that advisory disabled parking bays are not provided for the sole use of the applicant (Blue Badge holder) or for the sole use of residents of that property. It is provided for the use of any Blue Badge holder, however it is recognised that it will be used primarily by the applicant.


Eligibility Criteria for an Advisory Disabled Parking Bay (ADPB)

You can only be considered for an advisory disabled parking bay if:

  • You  hold a disabled persons' blue badge;
  • A child you care for receives Disability Living Allowance at the higher rate for the mobility component;
  • You receive Higher Rate Mobility component of Disability Living Allowance (if 16 to 65 years old) or Personal Independence Payment (PIP);
  • You receive Attendance Allowance (if over 65 years old);
  • You or one of your family living at the address is the registered owner of the vehicle;
  • The applicant lives at the address to which the application refers;
  • You do not have a drive, or alternative off-street parking or there is space within the property boundary of the address below to provide a suitable parking space;
  • There are no loading or waiting restrictions or bus stops/bays fronting the address;
  • Any part of the bay is not within 10 metres of a major road junction;
  • There is a parking problem on a regular basis within 25 metres of the address below;
  • The road is wider than 5.5m, which is considered to be the minimum required to safely place a bay;
  • The number of disabled parking bays in the road does not exceed 20% of the available kerbside space within 100 metres of the property;
  • The bay will not obstruct access to neighbours driveways either adjacent too or opposite from the proposed bay location;
  • Your property is not located within an existing Community Parking Management Scheme (CPMS) or a planned CPMS;
  • The bay will be on the road;
  • The bay is not in a shared residential parking bay or where there is not a clear distinction between the road and footway;
  • The address of the property is not on a classified road, e.g. A, B and C class roads

Please proceed only if ALL the above criteria can be met.
